DWI Mobile Videotaping for Police and
Prosecutors:
This timely manual discusses the operational and legal aspects of a mobile-videotape system, that is, a video unit mounted in the patrol car. The introduction - Mobile Video in America - discusses the problems with prosecuting DWI drivers and the reasons mobile video is needed to make DWI arrests stick and to increase the conviction rate of those who are prosecuted. Section I outlines the procedures, policies, training and selection of equipment to guide you through the obstacles of implementing a mobile video program in your agency. Next, you’ll learn the legal issues surrounding DWI mobile video through an examination of relevant case laws and situations. An Appendix contains two case tables. The first lists, by state, the cases that are relevant to mobile video and gives a synopsis of the main issues looked at by the court in each case. The second lists the various legal issues discussed in the text, such as admissibility, horizontal gaze nystagmus and liability for failing to arrest, and cites the cases that are relevant to each issue.
